Having researched the issue, it looks like reimbursing employees' gym membership, in whole or in part, is taxable income because most gifts and cash awards provided to an employee by an employer constitutes taxable income. EEOC Opinion Letter Concerning Health Risk Assessments

In an informal opinion letter, dated August 7, 2008 and clarified on March 6, 2009, the EEOC has stated that employees cannot be required to participate in a health risk assessment as a condition of receiving health care coverage.  The EEOC states that such a practice would violate the ADA because it considers the health risk assessment a medical inquiry that cannot be justified as a business necessity.The letter does point out, however, that an employee can voluntarily participate in the risk…See More

Health Care Reform Gives Employers More Tools

In 2014, the Affordable Care Act increases a reward or penalty to 30 percent of the costs of coverage for employees who meet the standards of a Wellness Program, such as quitting smoking or lowering cholesterol.

The reward should be based on total cost of the relevant coverage, not just what employees pay for their share of coverage. The reward can come in the form of discounts or rebates of premiums, waivers of all or part of a cost-sharing mechanism under the plan (such as…
